Terms & Conditions

PVS Imports supplies beverages exclusively on a business-to-business (B2B) basis to retailers, hospitality operators, food & beverage outlets, and distributors within Malta. No sales are made to private consumers.

All prices are quoted in EUR unless stated otherwise and are exclusive of VAT unless explicitly agreed in writing. VAT is charged at the applicable Maltese rate at the time of invoicing. Prices are subject to change without prior notice until an order is confirmed in writing.

Beverage container deposit fees (pant) are charged in accordance with applicable regulations and official deposit return schemes. Deposit fees are refundable subject to proper return of containers and do not constitute income for PVS Imports.

For first-time orders, the minimum order quantity is one full pallet (108 cases / 2,592 cans). Prices for initial orders may be slightly higher (+5–10%) to reflect logistics, insurance, and risk-related costs.

For B2B customers with valid VAT numbers, VAT may be applied under the reverse charge mechanism where permitted under Maltese VAT law.

First-time customers require full payment in advance. Credit terms may be granted to existing customers subject to approval and may be revoked at any time.

Orders are confirmed only upon written acceptance by PVS Imports. Amendments or cancellations after confirmation may incur costs. Minimum order quantities may apply. PVS Imports reserves the right to refuse or cancel any order prior to written confirmation.

Delivery times are indicative only. PVS Imports shall not be liable for delays caused by third-party logistics providers, customs procedures, shipping disruptions, or circumstances beyond reasonable control.

Ownership (title) of the goods transfers to the customer upon full payment. Risk of loss or damage passes to the customer upon delivery at the agreed delivery location.

Risk of loss, damage, or mishandling during transport remains with PVS Imports until the full order is delivered to the agreed delivery location, after which all responsibility passes to the customer.

Claims relating to shortages, damages, or incorrect deliveries must be submitted in writing within 48 hours of delivery.

Returns are accepted only with prior written approval. Returned goods must be unopened, unused, and resaleable.

PVS Imports shall not be liable for indirect, incidental, or consequential losses, including loss of profit or business interruption.

Total liability shall in all cases be limited to the invoice value of the goods supplied.

The customer is solely responsible for ensuring that products are stored, handled, marketed, and resold in compliance with all applicable laws, regulations, and industry standards. PVS Imports makes no warranties regarding resale performance, marketability, or suitability for any specific purpose.

Products are supplied with original manufacturer packaging and labeling. The customer is solely responsible for compliance with any applicable resale, labeling, deposit (pant), and consumer protection requirements, including obligations arising from resale to end consumers (B2C), regardless of jurisdiction. PVS Imports shall not be held liable for any fines, claims, or losses arising from non-compliance by the customer or third parties.

PVS Imports shall not be liable for failure or delay caused by events beyond its reasonable control.

These Terms & Conditions are governed by the laws of Malta.

Placement of an order constitutes full acceptance of these Terms & Conditions. PVS Imports reserves the right to amend these Terms & Conditions at any time. The version in force at the time of order confirmation shall apply.

All trademarks, trade names, and intellectual property rights related to supplied products remain the property of their respective owners. PVS Imports acts solely as an independent reseller unless explicitly agreed in writing.

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue to remain in full force and effect.
